Welcome, and thank you for your interest in CheckPaw ("CheckPaw," "we," "our," or "us"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CheckPaw regarding your access to and use of our platform and services, including the Telegram bot, web application, and mobile application (the "Service").

By accessing or using the Service, you agree to be bound by these Terms.

1. Service Overview

CheckPaw is a pet health tracking platform that connects pet owners with veterinary clinics. The Service allows users to maintain pet health records, schedule visits and reminders, track daily wellness, manage vaccination passports, and share pet data with chosen veterinary clinics.

2. Eligibility

By using the Service, you represent and warrant that:

  • You are at least 16 years old.
  • If you are below the age of majority in your jurisdiction, you have parental consent and supervision.
  • You have not been previously banned or suspended from the Service.
  • Your use of the Service complies with all applicable laws.

3. Accounts and Registration

Certain features require an account. When creating an account, you agree to:

  • Provide accurate and up-to-date information.
  • Maintain the confidentiality of your login credentials.
  • Be responsible for all activity under your account.
  • Use only one account per person. Transferring accounts to third parties is prohibited.

The Service may use your Telegram account for authentication and delivery of notifications. We may suspend or terminate accounts that violate these Terms.

4. Payment Terms

CheckPaw may offer free and paid features.

  • All fees are as displayed in the application at the time of purchase.
  • Payments are non-refundable, unless stated otherwise.
  • We may update pricing; you will be notified beforehand.
  • Failure to pay may result in suspension of premium features.

5. Ownership and Intellectual Property

All rights to the Service, including software, design, logos, and functionality, belong to CheckPaw or its licensors and are protected by intellectual property laws.

You retain ownership of your content. By uploading content, you grant CheckPaw a limited license to store, display, and process it solely to operate the Service. We do not claim any rights to your content beyond what is necessary to run the platform.

6. User Content

By submitting pet data, photos, medical records, or other materials ("User Content"), you represent that:

  • You own the content or have the right to use it.
  • Your content does not violate any intellectual property rights.
  • Your content complies with all applicable laws.

You are solely responsible for your content.

7. Veterinary Clinics and Delegated Access

Upon booking an appointment or explicit delegation, a chosen clinic gains limited access to pet data. The User defines the duration and scope of such access through the custodian system. CheckPaw is not responsible for the actions of clinics or veterinarians acting in their professional capacity.

8. Prohibited Conduct

You agree not to:

  • Use the Service for unlawful purposes.
  • Upload malicious scripts, viruses, or harmful code.
  • Attempt to access accounts or data belonging to others.
  • Scrape, copy, or redistribute the Service without permission.
  • Upload content that infringes third-party rights.
  • Interfere with the functioning or security of the platform.
  • Impersonate another person or submit fraudulent information.

Violations may lead to suspension or account termination.

9. Medical Disclaimer

THE SERVICE IS NOT A MEDICAL DEVICE AND DOES NOT REPLACE A VISIT TO A QUALIFIED VETERINARIAN. All health information, wellness scores, symptom assessments, recommendations, and reminders provided through the Service are for informational and advisory purposes only. They do not constitute veterinary medical advice, diagnosis, or treatment.

CheckPaw does not bear any responsibility for decisions made regarding the health, treatment, or care of animals based on information obtained through the Service. All decisions regarding your pet's health must be made by you in consultation with a qualified veterinary professional. You acknowledge that reliance on any information provided by the Service is solely at your own risk.

10. Third-Party Services

The Service integrates with Telegram for authentication and message delivery, and may use third-party providers for hosting, analytics, and infrastructure. Their own terms and policies apply in addition to these Terms.

11. Privacy and Communications

By using the Service, you agree to receive communications related to:

  • Account activity.
  • Security updates.
  • Service notifications.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." CHECKPAW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY.
  • FITNESS FOR A PARTICULAR PURPOSE.
  • NON-INFRINGEMENT.

We do not guarantee that the Service will be available without interruption or errors.

13. Limitation of Liability

To the fullest extent permitted by law:

  • CheckPaw shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or opportunities arising from use of the Service.
  • Where liability cannot be excluded, total liability is limited to the minimum required by applicable law.

14. Modifications to the Terms

We reserve the right to update these Terms at any time. If changes are significant, we will notify you through the Service. Continued use of CheckPaw after changes are posted constitutes acceptance of the updated Terms. Material changes may require renewed acceptance.

15. Indemnification

You agree to indemnify and hold harmless CheckPaw from any claims, damages, liabilities, and costs arising out of:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any laws or third-party rights.

16. Suspension and Termination

We may suspend or terminate access to the Service at any time as needed for security, maintenance, legal compliance, or upon a breach of these Terms. Users may delete their account at any time.

17. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Latvia. Courts of the Republic of Latvia have jurisdiction, without prejudice to mandatory consumer protection rights.

18. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and CheckPaw.
  • Severability: If any provision is found invalid, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any provision is not a waiver of that provision.
